Terms of Service

These Terms of Service (“Terms”) govern your use of the musiky mobile app for iPhone and iPad and this website (together, the “Service”), provided by Mihaela Dragomir (“we”, “us”). By downloading, installing or using musiky, you agree to these Terms. If you do not agree, please do not use the Service.

1. License to use musiky

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use musiky for your own personal, non-commercial use, in accordance with these Terms and the rules of the app store you downloaded it from. You may not rent, lease, sell, sublicense or redistribute the app.

2. musiky is a player, not a music source

musiky is an offline music player. It plays audio files that you import from your device or add from sources you connect (such as your own cloud drive). We do not provide, host or sell a music catalog, and we are not responsible for the media you choose to add.

You are solely responsible for the content you import and for ensuring you have the necessary rights to store and play it. You agree not to use musiky to infringe anyone’s copyright or other rights, or to violate any applicable law.

3. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• import or distribute content you do not have the right to use;
• reverse engineer, decompile or attempt to extract the source code of the app, except where allowed by law;
• interfere with, disrupt or attempt to gain unauthorized access to the Service or its related systems;
• circumvent, disable or tamper with any security or access-control feature (including limits tied to musiky Pro or ads).

4. Your account (optional)

You can use musiky without an account. If you create one to back up or sync your playlists and liked songs, you are responsible for keeping your credentials secure and for activity under your account. Let us know promptly if you suspect unauthorized use. You may delete a backup or your account from within the app at any time.

5. musiky Pro, purchases and subscriptions

musiky is free to use and offers an optional paid upgrade, musiky Pro, which removes ads and unlocks additional features. Purchases and subscriptions are sold and processed by Apple through the App Store and are subject to Apple’s terms.

• Subscriptions auto-renew until cancelled. You can manage or cancel a subscription in your App Store account settings.
• Payment is charged to your Apple account at confirmation of purchase and on each renewal.
• Refunds are handled by Apple in accordance with its policies.
• Prices and available plans may change; changes do not affect purchases already made.

6. Advertising and third-party services

Unless you have musiky Pro, the app displays advertising provided by third-party ad networks. The Service also lets you connect third-party services (for example, cloud drives you choose). These third parties operate under their own terms and privacy policies, and we are not responsible for their content, practices or availability. Your use of them is at your own risk.

7. Our intellectual property

The musiky app, its name, logo, design, and all related software and materials are owned by Mihaela Dragomir and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your requirements. You use the Service at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, Mihaela Dragomir will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising out of or related to your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold Mihaela Dragomir harmless from any claims, damages or expenses arising from content you import, your misuse of the Service, or your violation of these Terms or the rights of any third party.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or misuse the Service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability and indemnification) will continue to apply.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.

13. Apple App Store

The following applies if you obtained musiky from the Apple App Store:

• These Terms are between you and Mihaela Dragomir only, and not with Apple. Apple is not responsible for musiky or its content.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims.
• Apple is not responsible for the investigation, defense or resolution of any third-party intellectual property claim relating to the app.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
